This Pri­va­cy Pol­i­cy describes Our poli­cies and pro­ce­dures on the col­lec­tion, use, and dis­clo­sure of Your infor­ma­tion when You use the Ser­vice and tells You about Your pri­va­cy rights and how the law pro­tects You.

By using the Ser­vice, You agree to the col­lec­tion and use of infor­ma­tion in accor­dance with this Pri­va­cy Pol­i­cy. This Pri­va­cy Pol­i­cy has been cre­at­ed with the help of the Free Pri­va­cy Pol­i­cy Gen­er­a­tor.

Inter­pre­ta­tion

Def­i­n­i­tions

For the pur­pos­es of this Pri­va­cy Pol­i­cy:

  • Appli­ca­tion means the soft­ware pro­gram pro­vid­ed by the Com­pa­ny down­loaded by You on any elec­tron­ic device, named Smart Migra­tion South Moravia
  • Com­pa­ny (referred to as either „the Com­pa­ny“, „We“, „Us“ or „Our“ in this Agree­ment) refers to Jiho­moravský kraj, Žerotíno­vo náměstí 449/3, 601 82, Brno.
  • Device means any device that can access the Ser­vice such as a com­put­er, a cell­phone, or a dig­i­tal tablet.
  • Ser­vice refers to the Smart Migra­tion South Moravia appli­ca­tion.
  • Ser­vice Provider means any nat­ur­al or legal per­son who process­es the data on behalf of the Com­pa­ny. It refers to third-par­ty com­pa­nies or indi­vid­u­als employed by the Com­pa­ny to facil­i­tate the Ser­vice, to pro­vide the Ser­vice on behalf of the Com­pa­ny, to per­form ser­vices relat­ed to the Ser­vice, or to assist the Com­pa­ny in ana­lyz­ing how the Ser­vice is used.
  • Usage Data refers to data col­lect­ed auto­mat­i­cal­ly, either gen­er­at­ed by the use of the Ser­vice or from the Ser­vice infra­struc­ture itself.
  • Log Data refers to data col­lect­ed auto­mat­i­cal­ly in a case of an error.
  • You means the indi­vid­ual access­ing or using the Ser­vice, or the com­pa­ny, or oth­er legal enti­ty on behalf of which such indi­vid­ual is access­ing or using the Ser­vice, as applic­a­ble.

Col­lect­ing and Using Your Data

Types of Data Col­lect­ed

We do not col­lect any data that are per­son­al­ly iden­ti­fi­able to you!

How­ev­er, the app does use third-par­ty ser­vices that may col­lect infor­ma­tion used to iden­ti­fy you. Here are the links to the pri­va­cy pol­i­cy of third-par­ty Ser­vice providers used by the app:

Log Data

When­ev­er you use our Ser­vice, in case of an error in the app we col­lect data and infor­ma­tion (through third par­ty prod­ucts) on your phone called Log Data. This Log Data may include infor­ma­tion such as your Device Inter­net Pro­to­col (“IP”) address, Device name, oper­at­ing sys­tem ver­sion, the con­fig­u­ra­tion of the app when uti­liz­ing our Ser­vice, the time and date of your use of the Ser­vice, and oth­er sta­tis­tics.

Usage Data

Usage Data is col­lect­ed auto­mat­i­cal­ly when using the Ser­vice. When You access the Ser­vice by or through a mobile device, We may col­lect cer­tain infor­ma­tion auto­mat­i­cal­ly, includ­ing, but not lim­it­ed to, the request sent to the chat­bot, the type of mobile device You use, Your mobile Device unique ID, the IP address of Your mobile device, Your mobile oper­at­ing sys­tem, the type of mobile Inter­net brows­er You use, unique device iden­ti­fiers and oth­er diag­nos­tic data.

Loca­tion Infor­ma­tion

Your loca­tion infor­ma­tion is not col­lect­ed! While using Our Appli­ca­tion, in order to pro­vide fea­tures, Our Appli­ca­tion requests infor­ma­tion regard­ing your loca­tion. This infor­ma­tion is used just inside your device. It is not col­lect­ed or send any­where.

You can enable or dis­able access to this infor­ma­tion at any time, through Your Device set­tings.

Dec­la­ra­tion on Acces­si­bil­i­ty

The Office of the South Mora­vian region, locat­ed at Žerotíno­vo náměstí 449/3, 601 82 Brno, BIN: 70888337 (here­inafter as the “Office”) under­takes to make its smart mobile phone appli­ca­tion acces­si­ble in accor­dance with Direc­tive (EU) No. 2016/2102 of the Euro­pean Par­lia­ment and of the Coun­cil of 26 Octo­ber 2016, on the acces­si­bil­i­ty of the web­sites and mobile appli­ca­tions of pub­lic sec­tor bod­ies and Act No. 99/2019 Coll., on the avail­abil­i­ty of the web­sites and mobile appli­ca­tions of pub­lic sec­tor bod­ies.  

This dec­la­ra­tion on acces­si­bil­i­ty applies to the South Moravia Smart Migra­tion mobile appli­ca­tion (here­inafter only as the “mobile appli­ca­tion”). 

Accord­ing to Com­mis­sion Imple­ment­ing Deci­sion (EU) 2018/2048 of 20 Decem­ber 2018 on the har­mo­nized stan­dard for web­sites and mobile appli­ca­tions, these web­pages are cre­at­ed with regard to the fol­low­ing norms: EU har­mo­nized stan­dard EN 301 549 V2.1.2 (2018–08) Acces­si­bil­i­ty require­ments for ICT prod­ucts and ser­vices, Inter­na­tion­al stan­dard ISO 40500, Web con­tent acces­si­bil­i­ty guide­lines (WCAG) and the rules for acces­si­bil­i­ty accord­ing to Decree No. 64/2008 Coll., on acces­si­bil­i­ty.

 

Com­pli­ance Sta­tus

The mobile appli­ca­tion is cre­at­ed pur­suant to the basic prin­ci­ples of acces­si­bil­i­ty, which are per­ceiv­abil­i­ty, oper­abil­i­ty, under­stand­abil­i­ty and sta­bil­i­ty. This is in accor­dance with the require­ments on acces­si­bil­i­ty estab­lished by the rel­e­vant direc­tives, laws and inter­na­tion­al stan­dards, except for the fol­low­ing: 

  • The colours of the fore­ground and back­ground are not con­trastive enough in some less impor­tant texts and areas due to strict pro­cess­ing in accor­dance with the cur­rent­ly valid man­u­al of a uni­fied visu­al style and/or because of the graph­ic res­o­lu­tion of indi­vid­ual parts of the appli­ca­tion and the infor­ma­tion obtained there­in to increase intu­itive­ness.

 

Alter­na­tive man­ner of obtain­ing infor­ma­tion

If the mobile appli­ca­tion has infor­ma­tion which is not or can­not be acces­si­ble, the Office offers an alter­na­tive man­ner of obtain­ing infor­ma­tion in accor­dance with Sec­tion 7 para­graph 4 of Act No. 99/2019 Coll., on the avail­abil­i­ty of the web­sites and mobile appli­ca­tions of pub­lic sec­tor bod­ies, on the alter­na­tive man­ner of obtain­ing infor­ma­tion. It is pos­si­ble to con­tact the admin­is­tra­tor (via the e‑mail below), who will try to con­vey the rel­e­vant infor­ma­tion to the user in a suit­able form.

This dec­la­ra­tion was pre­pared by the Office on 15 August 2022 based on its own assess­ment.
